General Terms & Conditions
These General Terms govern every order submitted through the dealer portal. The dealer confirms that all vehicle, ECU, software, hardware, VIN, mileage, modification and fault-code information supplied with the order is complete and accurate. The dealer is responsible for obtaining the vehicle owner's authorization and for confirming that the requested work is lawful in the country, state or region where the vehicle is registered, operated or tested.
An order is not accepted merely because it has been submitted. Eagle Tuning may request additional identification, photographs, logs, diagnostic reports, proof of ownership, payment or technical information and may refuse or cancel work that is unsafe, unsupported, incomplete, unlawful or outside the available protocol. Estimated delivery times are targets rather than guarantees.
The dealer must retain a verified original backup and must follow the correct read, write, recovery, battery-support and tool-manufacturer procedures. The dealer must not write a file to a different ECU, software version or VIN unless Eagle Tuning gives written authorization. These terms apply together with all other policies accepted at checkout.
Terms of Service
The service consists of analysis and modification of electronic calibration data. It does not include mechanical inspection, mechanical repair, emissions certification, roadworthiness certification, dyno operation, ECU removal or installation, or recovery from an incorrect read/write unless separately agreed in writing.
OTS files are prepared from known calibration structures and the information supplied with the order. Custom files require complete and usable logs, correct measuring conditions and truthful hardware information. A custom label does not guarantee a particular horsepower, torque, fuel-economy or acceleration result. Actual results depend on engine condition, fuel quality, ambient conditions, drivetrain losses, hardware, sensors, transmission behavior and measurement method.
Revision requests must relate to the same VIN, ECU software, hardware configuration and original order. Changes to the vehicle, fuel, turbocharger, injectors, exhaust, intake, transmission or ECU software may require a new order. Support may be paused until requested logs, DTC scans or original files are supplied.
Liability and Warranty Policy
ECU and TCU programming carries inherent risk, including communication failure, checksum error, interrupted writing, ECU lock, no-start condition, component stress and the exposure of pre-existing mechanical or electrical defects. The dealer accepts responsibility for using stable battery support, compatible tools and correct recovery procedures.
Before writing a modified file, the dealer must confirm that the vehicle is mechanically sound and free from unresolved boost leaks, fuel-pressure problems, overheating, excessive oil consumption, transmission slip, injector faults, misfire, sensor faults or other conditions that make tuning unsafe. A modified calibration cannot repair a mechanical defect.
The limited service warranty covers correction of a demonstrable calibration defect in the delivered file for the same vehicle, VIN, ECU software and unchanged hardware configuration. It does not cover labor, towing, storage, lost business, lost profit, travel, diagnostic charges, replacement ECUs, engine or transmission damage, consequential loss, or damage caused by incorrect information, unsupported hardware, poor fuel, misuse, racing, overheating, over-revving, incorrect installation or third-party modification. Any limitation applies only to the maximum extent permitted by applicable law.
No Refund Policy
Calibration files are digital products prepared for a specific order. Once analysis, identification, map development, checksum work, file preparation or delivery has begun, the order is considered in progress and is generally non-refundable. Delivered custom or VIN-specific files cannot be returned in the same manner as physical goods.
A request for a different power level, additional function, new hardware configuration, different ECU software, different VIN or a preference change after work has started is not a refund basis and may require an additional order. If Eagle Tuning cannot supply any usable service for the submitted and accurately described application, the administrator may issue a credit or refund at its discretion, subject to payment-provider fees and applicable law. This policy does not remove rights that cannot legally be waived.
Payments, Refunds and PayPal Policy
Portal prices are shown in the currency assigned to the dealer's pricing profile unless the invoice states otherwise. Taxes, currency conversion, bank charges, card charges, PayPal charges and other payment-provider fees may be added or deducted as applicable. Fixed portal prices are estimates based on the selected service; unsupported software, encrypted files, special development, recovery work or items marked 'price on request' require administrator approval before the final price is confirmed.
Payment must be completed by the deadline shown on the invoice or administrator message. A dealer must not open a chargeback, PayPal dispute or unauthorized-payment claim without first giving Eagle Tuning a reasonable opportunity to review the order and technical evidence. Fraudulent or abusive disputes may result in suspension of the dealer account and collection of outstanding costs.
Where a refund is expressly approved, it is returned through the original payment method when practical. Non-refundable processor fees, currency differences and third-party charges may be deducted where permitted. The portal itself does not store full card or PayPal login credentials.
License Agreement
Every delivered calibration file is licensed, not sold. The dealer receives a limited, revocable, non-exclusive and non-transferable license to use the file only for the vehicle, VIN, ECU hardware and software identified in the order. The file may be written by the approved dealer or supplied to the identified vehicle owner solely for that vehicle.
The dealer must not resell, publish, upload, exchange, distribute, sublicense, reverse engineer, compare for cloning, remove identifying information from, or use the file to create files for another vehicle or customer. The dealer must not share portal credentials or permit unauthorized persons to access files, pricing, messages or customer data.
All calibration strategy, map definitions, patches, scripts, documentation and file-service methods remain the intellectual property or confidential know-how of Eagle Tuning or its licensors. Breach of this license may lead to immediate suspension, termination of support and legal action.
NO VIN = NO SUPPORT
A complete and accurate VIN/chassis number is mandatory for every order. Support, revisions, file identification and warranty review are provided only for the VIN recorded when the order is submitted.
An order submitted without a VIN, with a false VIN, with an incomplete VIN, or with a VIN belonging to another vehicle may be rejected, delayed or closed without technical support. If the ECU has been swapped, cloned or replaced, the dealer must disclose both the vehicle VIN and all relevant donor-ECU information. A correction caused by an incorrect VIN may be treated as a new paid order.
SMS Verification Terms
Eagle Tuning may send transactional SMS messages to the mobile number you provide for dealer-account registration, phone-number verification, authentication, account security and closely related portal-service purposes. These messages may include one-time verification codes (OTP), security notices and other account-verification communications. This SMS program is not used for promotional or marketing messages.
Message frequency varies based on verification and security requests associated with your account. Message and data rates may apply depending on your mobile carrier and plan. Reply STOP to opt out of further SMS messages from the sending number. Reply START or UNSTOP to opt back in where supported. Reply HELP for assistance, or contact Eagle Tuning at [email protected]. Telnyx and participating mobile carriers may process standard opt-out keywords and may block further messages after an opt-out request.
Mobile carriers are not responsible for delayed or undelivered messages. SMS delivery is not guaranteed and can depend on carrier filtering, network availability, handset settings, sender registration and other factors outside Eagle Tuning's control. By selecting the separate SMS-consent checkbox and requesting a verification code, you expressly consent to receive the transactional SMS messages described in this section at the number you provided.
Privacy Policy
Eagle Tuning processes registration, contact, company, vehicle, order, uploaded-file, support and notification data to provide the dealer portal and related ECU/TCU file services. Data is used for account verification, fraud prevention, order processing, technical support, billing, service notifications and legal compliance.
We do not sell dealer or customer personal information. Access is limited to authorized personnel and service providers required to operate the portal, such as hosting, transactional email, messaging and notification providers. Data may be retained for security, accounting, dispute resolution and service-history purposes. Users may request correction of inaccurate account information and may disable optional marketing communications.
SMS and mobile information: We use the mobile phone number you provide, together with your SMS opt-in/consent status, to deliver transactional messages related to account verification, authentication, security and requested portal services. Your mobile information and SMS opt-in or consent information will not be sold, rented or shared with third parties or affiliates for promotional or marketing purposes. We will not share your opt-in to an SMS campaign with any third party for purposes unrelated to providing the services of that campaign. We may share personal data, including your mobile number and SMS opt-in or consent status, with service providers that help us operate the messaging service, including messaging-platform providers, telecommunications providers and mobile carriers, solely as necessary to provide the requested messaging service.
All data-sharing categories described in this Privacy Policy exclude text-messaging originator opt-in data and consent from sharing for promotional or marketing purposes. SMS consent is specific to the messaging program described in the SMS Verification Terms and is not combined with newsletter or email-marketing consent.
Passwords are stored using one-way password hashing. Email-verification and password-reset links are single-use and expire. Dealers remain responsible for ensuring that any vehicle-owner or customer information uploaded to the portal is supplied lawfully and with the required authorization.
